Terms of Service

Clients are required to read and agree to the Terms and Service listed below. Payment of sent invoice (from the artist) is an agreement from the client that they have read, agreed, and comply with the terms and conditions laid out by the artist below.I know it's a lot to read but it is important that clients read and agree to the terms of service. It is for the protection of both you (the client) and I (the artist).

Payment

- Full payment is required upfront.
- Paypal Invoice only, using USD currency.
- Ensure that you can afford/wait for the commission.
- The Commission will not be started until after payment has been confirmed.
- Invoice will remain valid for 7 days. - No payment within this time frame will result in a cancellation of your commission and losing your place on the waitlist.

Pricing

- The prices listed are an estimate and all prices are subject to change depending on the detail/complexity of each commission.
- The artist reserves the right to increase the price and or request additional fees. Fees will not be applied without confirmation from the client. If the client does not accept the fee, the commission will either; not be taken or further work on the commission will be terminated.
- Once total cost is calculated, an additional invoice processing fee of 3.5% will be added

Refunds

- If no work or sketches have been done by the artist, a client is entitled a 95% Refund (due to Paypal processing fees)
- Commissions are non refundable once a sketch has been created and shown to client
- The client will not request any Paypal chargebacks once a sketch has created and/or rendering has started.
- Artist reserves the right to cancel any commission for any reason. Should this occur, a full refund will be provided.

Revisions

I allow for 3 free major revisions during a commission process. If something needs to be changed or adjusted, the sketching phase is where it should happen! I always want clients to be 110% happy with their piece so please do not hesitate to let me know about changes during this stage. After sketches are approved, the rendering phase begins and major changes become more difficult to do. I will allow for small changes to be made (color changes, minor detail alterations, etc) during this stage but please note that major changes after the sketching phase are subject to additional fees and charges.

Licensing and rights

- The artist retains FULL copyright and rights to the artwork, including but not limited to posting the finished artwork on their social media platforms and sharing the artwork as an example of their work
- By commissioning, the client understands that they do not own the copyright of the artwork and are purchasing a Personal Use License and/or a Commercial Use License.

Personal Use License

- All commissions are a purchase of a Personal Use License which means the client may use the commissioned artwork for PERSONAL USE. This includes as emotes on Twitch.tv or their personal Discord server, icons, pfp, and non-profit digital advertising
- The client MAY NOT claim credit, sell the artwork as prints or use it on any merchandise. They can not trace, copy, or resell the artwork. Any edits done to the artwork can be brought back to the artist for adjustments
- The client must need to purchase an Commercial Use License to use the artwork for merchandise and profit (read below for more information)

Commercial Use License

- Commercial Use License are bought on top of a Personal Use License and are on average the total cost of a commission +half of the total.
For example: 1 emote ($30) with a commercial Use License (an additional $45) will cost a total of $75
- Commercial Use License can be purchased at any time before the sale of the artwork by the client. If you would like to buy a Commercial Use License for a commission that was already completed, simply message me for further details on how to buy a Commercial Use License.
- Purchasing a Commercial Use License, the client obtains the right to use the artwork for commercial profit in the form of merchandise (stickers, mugs, shirts, prints, etc)

MY ART CAN NOT be used for crypto profit, sale, or use. The art MAY NOT be used or uploaded as an NFT or anything of the sort. NONE of my art OR commissions can be uploaded into any sort of AI database or program.

Content

- The products provided to the client are digital goods. No physical products will be shipped.
- If there are multiple files it will be delivered via email or Discord in a Zip file. If you would prefer it to be delivered differently let the artist know.
- The artist is not responsible for making sure an emote adheres to Twitch or Discord's TOS and or Community Guidelines.
